These Terms and Conditions (“Terms”) govern the purchase of Nitrous Oxide (N2O) products, including cream chargers and cylinders, from The Smart marketing & media group ltd (“we,” “us,” or “our”). By placing an order, you agree to be bound by these Terms and the legal requirements set forth by the UK Government under the Misuse of Drugs Act 1971 and the Psychoactive Substances Act 2016.

1. Legal Compliance and Classification

As of November 8, 2023, Nitrous Oxide is classified as a Class C controlled drug under the Misuse of Drugs Act 1971. It is a criminal offence to possess, supply, or import Nitrous Oxide unless it is for a legitimate, lawful purpose, such as professional catering or industrial use.

2. Intended Use and User Declaration

By purchasing from The Smart marketing & media group ltd, you explicitly represent, warrant, and declare that:

• Legitimate Use: You are purchasing the product strictly for legitimate culinary or catering purposes (e.g., whipping cream, aerating mousses, or infusing oils).
• No Misuse: You do not intend to possess the substance with the intent to wrongfully inhale it for a psychoactive effect, nor will you supply it to others for this purpose.
• Professional Capacity: You are a professional caterer, a registered business, or a legitimate hobbyist using the product exclusively for its intended food-grade application.

3. Age Restrictions and Verification

• Minimum Age: You must be at least 18 years of age to purchase Nitrous Oxide products.
• Verification Checks: We employ strict age-verification protocols. You may be required to provide valid, government-issued photographic ID (such as a Passport or UK Driving Licence) at the point of sale or upon delivery.
• Refusal of Sale: If we cannot independently verify your age, or if we suspect the product is being purchased by or on behalf of a minor, your order will be cancelled immediately.

4. Anti-Misuse Policy and Order Limits

Under UK law, it is an offence for a supplier to be “reckless” as to whether a product will be misused. To ensure total compliance and prevent diversion to the recreational market, we strictly enforce the following:

• Order Limits: We reserve the right to impose maximum quantity limits on individual orders and monitor the frequency of purchases from the same customer or address.
• Red Flag Monitoring: We actively monitor transactions for indicators of potential misuse, including but not limited to:
  • Unusually large order quantities.
  • High-frequency repeat orders.
  • Delivery to non-business, temporary, or student accommodation addresses.
  • Orders placed late at night.
  • Use of language or email addresses suggesting recreational use.

5. Right to Refuse, Cancel, and Report

• Cancellation Right: The Smart marketing & media group ltd reserves the right to refuse, cancel, and refund any order at our sole discretion, without providing a reason, if we have reasonable grounds to suspect the product may be misused.
• Law Enforcement Cooperation: If we suspect criminal intent, fraudulent activity, or illegal distribution, we will report the transaction, including all associated personal data (names, addresses, payment details), to the relevant authorities, including the Police and Trading Standards.

6. Safety and Storage

Nitrous Oxide is a highly pressurized gas. By purchasing, you agree to:

• Store products in a cool, dry, and well-ventilated area, away from direct sunlight and temperatures exceeding 50°C.
• Follow the manufacturer’s operating instructions for the specific catering equipment used.
• Never attempt to pierce, refill, or dismantle cylinders or chargers.
• Health Warning: You acknowledge that inhaling Nitrous Oxide is extremely dangerous and can lead to asphyxiation, unconsciousness, severe vitamin B12 deficiency, permanent nerve damage, or death.

7. Resale and B2B Transactions

• You are strictly prohibited from reselling these products to any individual or entity that you suspect may use them for recreational purposes.
• If you are a wholesaler or B2B customer, you must implement and maintain your own robust age-verification and anti-misuse protocols that comply fully with Home Office guidance. You may be required to provide evidence of your business operations (e.g., Company Registration Number, VAT number) prior to fulfilment.

8. Delivery Protocols

• Challenge 25: Our delivery partners operate a strict “Challenge 25” policy. If the recipient appears to be under the age of 25, they must provide valid ID upon delivery.
• Non-Delivery: Packages will not be left in safe spaces or with neighbours. If delivery is refused due to a lack of ID or suspected misuse, the goods will be returned to us, and a restocking fee may be deducted from your refund.

9. Indemnity

You agree to indemnify, defend, and hold harmless The Smart marketing & media group ltd, its directors, employees, and affiliates against any claims, liabilities, damages, judgments, or legal actions resulting from your breach of these Terms, including any illegal possession, use, or onward supply of the products.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the purchase of restricted goods shall be subject to the exclusive jurisdiction of the courts of England and Wales.
